Your Assets Are Just Sitting There!

Okay, you’ve sunk a cool half-million dollars in your small fleet of commercial heavy duty trucks (say 8 trucks) and most of them now sit idle in your yard.  Now, you have to figure out how much each one will cost to get them fixed – then you have to figure out if the maker has a faulty design or some faulty materials since so many are sidelined at the same time.  Okay, now you have to figure out what to do about your high blood pressure spikes, the employees idled by this, the lost booked business, the lost potential business, the lost client good will – and then back to doing something about that spiking blood pressure.

Then you go to a lawyer to see what obligations are owed by the manufacturer.  He looks around for an expert who can get inside the rigs and see what is happening (more…)

International firms move to greater use of renewable resources

Kudos to all the companies seeking to increase use of renewable resources! A major international sportswear company has a network of manufacturers located around the globe. They have had a major initiative for the past three years to move these global manufacturers to using biomass for energy to power the plants.  They are moving from such fossil fuels as bunker oil to biomass fuels to power textile plants. In 2012 this company achieved < 35% of power for the plants coming from renewable resources.

Now, being an aware and responsible company, they wanted to make sure that the plants were operating utilizing best practices – not just for efficiency, but also for safety and working conditions.  What does a globally responsible company do to gain an objective view of their operations? (more…)

Well, it could be the GPS that’s wrong!  An Intota expert was engaged to untangle a situation where the satellite location device said that someone was at place X going Y speed (sounds like the beginning of a math story problem, right?).  His bosses said – “Hey that is speeding!” and put him on report. Taking on the Electric Company

In May a few years ago, an electric transmission line owned by the local power company failed. A span of line that had been installed a quarter of a century before and spliced numerous times over the years finally gave way and fell. The resulting fire consumed 1100 acres, including the plaintiff’s home. He lost tools, furnishings, and many personal belongings. Defense attorneys had asked the judge to dismiss the case. This is when the plaintiff’s attorney contacted Intota to find an expert in electrical line accidents and safety requirements. Did you hear the one about two attorneys who went into a bar?

Opposing counsels were traveling to depose an Intota expert.  The case involved a particular type of food poisoning and plaintiff counsel had retained an Intota expert to review and report about the histamine content of the food. The two attorneys ended up—by some wild stretch of coincidence—using the same exact travel itinerary and both missed a connecting flight in the Minneapolis/Saint Paul airport.  They adjourned to an airport bar for a couple of drinks and dinner. Intota Experts Stepping up to the Problem of Beefy Bacteria

The EU has a beef with bacteria hitching a ride on cow skins and contaminating beef at slaughterhouses.  It’s been that pesky e. coli bacteria that has caused a variety of havoc over the past years here in the states (see here and here for examples) and continues to make us question our food safety. Leafy greens have been the more famous culprits of late; however meat has been a perennial favorite source for many years.

After much research, the EU funded ProsafeBeef has come up with an idea that could stop one transmission mechanism for this pathogen – douse the beef carcass before it is skinned with shellac!  Your home furniture improvement project old standby now moves into the 21st century.

Biostatistic Experts in False Advertising Litigation

Okay – I knew that biostatistics was a widely used expertise in litigating product liability/mass torts. With all the clinical data brought to bear in these cases, the statistical arguments can be quite dense (in the positive sense of the word, of course!) and quite important to determining the facts of the matter. Statistical methods are used to organize and interpret whether clinical trials have proven the efficacy of a drug or nutritional supplement. If the clinical trial data is shown to be lacking – then the product could not only be shown to be inadequate or even injurious, but also the level to which parties understood this liability.
BUT, what is new to me is the use of biostatistics in false advertising litigation. (more…)
